The hearing loss VA claim: why real damage still rates 0%
You know your ears are shot. The audiogram proves it. Then the decision says service-connected at 0 percent. Here is why the VA formula does that, and where the claim is actually won.
Hearing loss and tinnitus are the two most common service-connected conditions in the country. Almost every veteran who stood next to a flight line, a turret, a diesel engine, or a rifle range has some of it. So when a decision comes back saying your hearing loss is service-connected but rated 0 percent, it feels like a trick. The VA agreed the military damaged your ears, then paid you nothing for it.
It is not a trick, and it is usually not an error. It is the formula. The way the VA measures hearing is narrow and mechanical, and a lot of real, daily-life hearing damage does not move the number the formula cares about. Once you see how the machine works, your 0 percent stops being an insult and starts being something you can actually plan around.
The short version
The VA does not rate how bad your hearing feels. It runs two specific tests, converts them into a Roman numeral for each ear, and looks up a percentage on a fixed table. That table is strict. You can have obvious hearing damage and still land on 0 percent because your scores did not cross the lines the table draws. The C&P audiologist who runs those two tests is the person who decides your rating.
The two tests that decide everything
Under 38 CFR §4.85, a hearing claim is rated on exactly two measurements, and both have to be done by a state-licensed audiologist, without your hearing aids in:
- The Maryland CNC test. This is a controlled speech discrimination test. The audiologist reads a list of single words and scores what percentage you repeat back correctly. "Maryland CNC" is just the name of the specific word list the VA requires. It measures how well you understand speech, not how loud it has to be.
- Puretone audiometry. This is the beeps-in-the-headphones test. It measures the quietest sound you can hear at four pitches: 1000, 2000, 3000, and 4000 Hertz. The VA averages those four numbers into one score called your puretone threshold average.
That is it. Not how often you say "what," not how much you struggle in a crowded room, not how loud you run the TV. Two numbers per ear.
How two numbers become a rating
The VA takes your speech score and your puretone average and crosses them on a grid called Table VI. Where they meet, you get a Roman numeral from I (near normal) to XI (profound loss). It does that for each ear separately. Then it takes the Roman numeral from your better ear and your worse ear and crosses them on a second grid, Table VII, which spits out the final percentage.
Here is the part that produces all the 0 percent decisions: on Table VII, a lot of real hearing loss still lands in the bottom corner. If your speech discrimination is still decent, say you are getting most of the words right in a quiet booth, your Roman numeral stays low even when the puretone beeps show clear high-frequency damage. Two low Roman numerals cross at 0 percent. The regulation is doing exactly what it was written to do. It just was not written to reward the kind of loss most veterans have.
Why the quiet booth lies
Noise-induced hearing loss mostly kills the high frequencies, which is where consonants live. You hear that there is sound, you just cannot tell "fifteen" from "fifty." In a silent test booth with one clear voice, you compensate and score well. In a bar or a briefing room you are lost. The test rewards the booth. That gap is real, and it is worth documenting in your own words even though it will not change the Table VI math.
The exception that can rescue a claim
There is a relief valve for severe or oddly shaped hearing loss, written into 38 CFR §4.86, called exceptional patterns of hearing impairment. It covers two situations:
- Pattern one: your puretone threshold is 55 decibels or more at all four frequencies (1000, 2000, 3000, and 4000 Hz). That is uniformly severe loss.
- Pattern two: your threshold is 30 decibels or less at 1000 Hz but 70 decibels or more at 2000 Hz. That is a steep ski-slope drop, the classic noise-damage shape.
If either pattern fits, the rater is allowed to score that ear off the puretone average alone, using an alternate grid called Table VIa, and pick whichever result gives you the higher Roman numeral. For a steep-drop pattern the numeral also gets bumped up one level. This is the one place the formula bends toward the veteran, and it is worth knowing your own audiogram numbers well enough to spot whether you qualify.
Service connection is a separate fight from the rating
Two questions live inside a hearing claim, and people blur them. First, did the military cause it. Second, how bad is it now. The 0 percent problem above is the second question. But you still have to win the first, and that is where your service record does the work.
The strongest evidence is your military job and where you did it. Your MOS or rating, your duty stations, and any hazardous-noise or hearing-conservation records tell the story before you say a word. An infantryman, an artilleryman, a boiler technician, or a flight-deck sailor all carry obvious noise exposure that a rater recognizes on sight. If your job was noisy, name it plainly and let the record carry it. If your job title does not scream noise, a short buddy statement describing the range time, the generators, or the convoys fills the gap. Your entrance and separation audiograms, if they show a shift, are the cleanest proof of all.
Why the C&P audiologist is the whole ballgame
Because the rating comes straight off two tests, the person who administers those tests holds your claim in their hands. The rater in the back office does not re-measure your hearing. They read the C&P audiologist's report and look up the table. If the booth was quiet, if you were having a good ear day, if you guessed well on the word list, those numbers become your rating and they are hard to unwind later.
So treat the exam as the decision, because it is. Do not tough it out or minimize. Answer honestly, ask the audiologist to repeat words you did not catch rather than guessing, and afterward request a copy of the exam so you can check the actual decibel and speech numbers against the tables. If the report leaves out an exceptional-pattern that your own audiogram shows, that is a concrete, cite-able reason to ask for a review.
Where to verify this yourself
None of this is a rater's opinion. The tests, the tables, and the exceptions are fixed in law.
